Acceptance of Terms
Welcome to Pisoro. By accessing and/or using our Services, you as the user thereof agree to comply with and be bound by the following Terms of Service (“Terms”). Please review the following terms carefully. By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are entering these Terms on behalf of a company, business, or other legal entity, you represent that you have the authority to bind such entity and its affiliates to these Terms, in which case the terms “you” or “your” shall refer to such entity and its affiliates. If you do not have such authority, or if you do not agree with these terms, you may not access or use the Service.
Changed Terms
We may from time to time change, remove, or add to the Terms, and reserve the right to do so in our discretion. In that case, we will post updated Terms and indicate the date of revision. All updated Terms will be effective immediately if you are a new user of the Service and will become effective if you have an existing account. We encourage all users to review the Terms from time to time to ensure familiarity with the most current version. The Terms were last modified on this date. Your continued use of the Service following the posting of updated Terms of Use constitutes your acceptance of such changes.
Definitions
“Service” refers to the Pisoro platform including the website at Pisoro.com, mobile applications for iOS and Android, and any related software, tools, features, or functionalities provided by Pisoro. “User” refers to any individual who accesses or uses the Service, whether as a “Piro” (pet owner/companion) or a “Soro” (veterinary professional). “Content” refers to text, images, graphics, data, messages, or other materials uploaded, submitted, stored, sent, or received via the Service. “Account” refers to a registered user profile that allows access to the Service and its features.
Description of Services
Pisoro provides a platform connecting pet owners (“Piros”) with veterinary professionals (“Soros”) to facilitate pet care management, appointment scheduling, health record tracking, and related services. The Service includes, but is not limited to: pet profile management, veterinary appointment booking, health record storage and sharing, communication tools between pet owners and veterinarians, educational content about pet care. Pisoro reserves the right to modify, suspend, or discontinue any aspect of the Service at any time without notice or liability.
Registration Obligations
By registering to use the Service, you agree to provide accurate, current, and complete information about yourself as prompted by our registration form. You agree to maintain and promptly update your registration data to keep it accurate, current, and complete. You must be at least 18 years of age to register. By registering, you represent and warrant that you are 18 years of age or older. Pisoro reserves the right to refuse service, terminate accounts, or remove or edit content in its sole discretion.
Account Security
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers, and symbols) with your account. You agree not to disclose your password to any third party. You must notify Pisoro immediately upon becoming aware of any breach of security or unauthorized use of your account. Pisoro will not be liable for any losses arising from the unauthorized use of your account.
User Conduct
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service: in any way that violates any applicable national or international law or regulation; to transmit, or procure the sending of, any advertising or promotional material without our prior written consent; to impersonate or attempt to impersonate Pisoro, a Pisoro employee, another user, or any other person or entity; to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service; or in any manner that could disable, overburden, damage, or impair the Service.
Intellectual Property Rights
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Pisoro and its licensors. The Service is protected by copyright, trademark, and other laws of both domestic and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Pisoro. Nothing in these Terms shall be construed as granting any license or right to use any of our trademarks displayed on the Service without our express permission.
Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Service or contact us to close your account. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Disclaimer of Warranties
YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. Pisoro, its subsidiaries, affiliates, and its licensors do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location; any errors or defects will be corrected; the Service is free of viruses or other harmful components.
Limitation of Liability
IN NO EVENT SHALL PISORO, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE. This limitation applies regardless of whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Pisoro has been advised of the possibility of such damage.
Indemnification
You agree to defend, indemnify, and hold harmless Pisoro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws applicable in your jurisdiction, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
